PCT is an international treaty which offers a unitary, simplified filing procedure, followed by an international search and, at the applicant's option, an international preliminary examination, for over 120 countries. The PCT is administered by the World Intellectual Property Organization (WIPO) in Geneva. The Turkish Patent Institute act as the Receiving Office for the Turkish citizens and residents. The EPO may act under the PCT as a receiving Office, an International Searching Authority and a Preliminary Examining Authority. European patents may be granted on the basis of international applications filed under the PCT. A list of member states to the PCT can be obtained from : http://www.wipo.int/pct/en
PCT Natioanal Phase Entries in Turkiye
We require following documentation when a PCT national phase entry is to be filed with the Turkish Patent Institute;
- Number of the international publication
- Any amendments to be filed with the national phase application
- Your written instruction letter
We do not need a power of attorney to file a national phase entry. The POA is required only under exceptional circumstances, such as when to assign an application or eg. to withdraw an application.
Costs
The typical cost of a PCT national phase entry in Turkiye is 900.-EUR plus translation costs inclusive of all official and profesional fees. The translation cost is 18.-EUR per 100 words from English to Turkish.
The EURO-PCT Route
A European Patent Application may be filed as an extension of a PCT application if the international application designates the EPO.
We require following documentation when a the European phase of a PCT application is to be initiated ;
- Number of the international application
- Any amendments to be filed with the national phase application
- Your written instruction letter
We do not need a power of attorney to file the European phase of your international application.
In cases where the international search authority (ISA) is other than the EPO, the Swedish Patent Office or the Austrian Patent Office, a request for a supplementary European search shall be filed with the EP regional phase application.
